Operator and scope
Kerry Kier, an individual, operates Cappy West as an independently run personal publishing website with a commercial book-promotional purpose. Kerry Kier is also the author and self-publisher of the Cappy West books and may receive ordinary author or publisher royalties from book sales.
These Terms apply to cappywest.com, its locally served games and reading materials, and links that leave the site. They do not replace the separate terms or privacy practices of a retailer or another third party.
Permitted use
Cappy West grants visitors a limited, revocable, non-exclusive, and non-transferable license to view and play the site for personal, household, and classroom use. Ordinary links to the site and reasonable quotations for review, commentary, teaching, or reporting are welcome when accompanied by attribution and used consistently with applicable law.
This license does not authorize copying or redistributing substantial portions of the books or site, selling or republishing site material, creating unapproved adaptations, scraping the site, or exploiting the site commercially. Rights that applicable law independently grants to a visitor remain unchanged.
A grown-up's role
Children may explore the child-facing pages and play the games without creating an account or submitting information to the application. A parent, caregiver, educator, or other responsible grown-up must handle retailer visits, purchases, and email correspondence.
Retailer links and royalties
Book pages contain visitor-activated links to independent retailers. After a visitor activates a link, the retailer controls its prices, availability, formats, accounts, payments, fulfillment, returns, refunds, privacy practices, cookies, and customer support.
Kerry Kier may receive ordinary author or publisher royalties when a book is sold. The current links do not generate an affiliate or referral commission for Cappy West. A future commission arrangement would be disclosed beside the affected link and reflected in these Terms.
Kerry Kier is the rightsholder for the protectable human-authored contributions to the Cappy West books, stories, series, and original characters. Rights in generated or computer-assisted material are claimed only for protectable human contributions and the resulting selection, coordination, arrangement, editing, and compositing, to the extent permitted by law.
Original site copy, design implementation, code, game text, character expression, artwork, audiovisual presentation, and creative arrangement are proprietary to Kerry Kier to the extent protected by law. Cappy West does not claim exclusive rights in abstract ideas, rules, or game mechanics. Third-party software, fonts, icons, retailer badges, and other identified material remain subject to their own licenses and notices.
Cappy West is used as the series and brand name. No registered or unregistered trademark claim is made here, and no trademark symbol is used.
Prohibited use
Visitors may not use the site unlawfully; conduct unauthorized security testing; bypass access controls; send disruptive automated traffic; remove copyright, license, or attribution notices; falsely suggest affiliation or endorsement; or interfere with another person's use of the site.
Disclaimers and limitations
The site and games are provided as is and as available, to the maximum extent permitted by law. They offer entertainment and general educational information. Cappy West does not promise a particular learning outcome or warrant that every country fact, link, feature, or service will always be complete, current, accurate, available, uninterrupted, or error-free.
To the maximum extent permitted by law, Kerry Kier is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the site. These Terms do not exclude a warranty, remedy, or liability that applicable law does not permit to be excluded, and they do not impose a fixed dollar liability cap or a broad indemnity obligation on a child or family.
Governing law and disputes
California law governs these Terms without regard to conflict-of-law rules, except where applicable law provides otherwise. Subject to applicable law, disputes may be brought in the state or federal courts located in Sacramento County, California.
Before filing a claim, please email a description of the dispute and allow 30 days for an informal effort to resolve it. This process does not prevent either side from using qualifying small-claims procedures or seeking appropriate injunctive relief for intellectual-property misuse.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a provision is not a waiver. These Terms and the documents they expressly incorporate are the entire agreement about use of the site.
